TERMS & CONDITIONS
Article 1 – Definitions
In these general terms and conditions, the following definitions apply:

CHAY: the sole proprietorship CHAY, located at Groningenhaven 1-2, 3433 PE Nieuwegein, the Netherlands, registered with the Chamber of Commerce under number 86181076.

Entrepreneur: CHAY.

Customer: any natural person who does not act in the exercise of a profession or business and enters into an agreement with CHAY.

Agreement: any agreement concluded between CHAY and the customer via the webshop or other sales channels.

Products: all goods offered by CHAY, including clothing and accessories.
Article 2 – Applicability

These general terms and conditions apply to every offer made by CHAY and to every distance agreement concluded between CHAY and the customer.

Deviations from these terms and conditions are only valid if expressly agreed upon in writing.

Any general terms and conditions of the customer are expressly rejected.
Article 3 – The Offer

The offer contains a complete and accurate description of the products offered.

Images and descriptions are as accurate as possible but cannot give rise to any right to compensation or termination of the agreement.

Obvious mistakes or errors in the offer do not bind CHAY.
Article 4 – Formation of the Agreement

The agreement is concluded at the moment the customer accepts the offer and meets the conditions set.

After placing an order, the customer will receive an order confirmation by email.

CHAY reserves the right to refuse orders or request additional information.
Article 5 – Prices

All prices are stated in euros and include VAT, unless stated otherwise.

Shipping costs are stated separately before the order is finalized.

CHAY reserves the right to change prices. Price changes do not affect agreements already concluded.
Article 6 – Payment

Payment must be made using the payment methods offered in the webshop.

CHAY reserves the right to suspend or cancel an order if payment is not completed.

If the customer is in default, CHAY is entitled to charge statutory interest.
Article 7 – Delivery

CHAY will exercise due care when processing and shipping orders.
-
Delivery takes place at the address provided by the customer.
-
Stated delivery times are indicative and not strict deadlines.
-
The risk of damage or loss transfers to the customer upon delivery.
Article 8 – Right of Withdrawal
-
The customer has the right to withdraw from the agreement within 14 days after receiving the product, without giving any reason.
-
During the withdrawal period, the customer shall handle the product and packaging with care.
-
The product must be returned unused, unwashed, and—where reasonably possible—in its original condition.
-
Return shipping costs are borne by the customer.
Article 9 – Exclusion of the Right of Withdrawal

The right of withdrawal is excluded for products that cannot be returned for hygienic reasons if the seal has been broken.
Article 10 – Refunds

If the customer exercises the right of withdrawal, CHAY will refund the purchase amount within 14 days after receipt of the returned product.

Refunds will be made using the same payment method used for the original transaction.
Article 11 – Liability

CHAY is not liable for indirect damage, consequential damage, or loss of profit.

The liability of CHAY is limited to the amount of the relevant order.
-
CHAY is not liable for damage resulting from improper use of the products.
Article 12 – Complaints

Complaints must be submitted in writing within 7 days after discovery via CHAY’s contact details.

CHAY will handle complaints within a reasonable period of time.
Article 13 – Force Majeure

CHAY is not obliged to fulfill any obligation if prevented from doing so by force majeure.

Force majeure includes any circumstance beyond the control of CHAY.
Article 14 – Intellectual Property

All intellectual property rights relating to the products, website, and content belong to CHAY.
-
It is not permitted to copy, distribute, or otherwise use materials from CHAY without prior written consent.
Article 15 – Governing Law and Disputes
-
All agreements between CHAY and the customer are governed by Dutch law.
-
Disputes shall be submitted to the competent court in the Netherlands.
